Terms and Conditions
- Introduction
These Terms and Conditions (“Agreement”) govern the use of the services provided by Earthlink Industries Pty Ltd (“Company”), including but not limited to wet and dry hire services. By using our services, you agree to be bound by the terms of this Agreement.
- Definitions
“Customer” refers to any person, entity, or organization that uses our services, including but not limited to renting or leasing equipment from us.
“Equipment” refers to any machinery, tools, vehicles, or other items that are rented or leased by the Company to the Customer.
“Rental Period” refers to the duration of time during which the Equipment is rented or leased by the Customer.
- Rental Agreement
The Company agrees to rent or lease Equipment to the Customer during the Rental Period, subject to the terms and conditions of this Agreement.
- Payment
The Customer agrees to pay the Company for the use of the Equipment as outlined in the Rental Agreement. Payment must be made in full before the Equipment is delivered or picked up by the Customer.
- Liability
The Customer assumes all risk and liability associated with the use of the Equipment during the Rental Period. The Customer agrees to indemnify and hold the Company harmless from any claims, damages, or expenses arising from the use of the Equipment.
- Maintenance and Repair
The Customer is responsible for maintaining the Equipment in good condition during the Rental Period. If any repairs or maintenance are necessary, the Customer must notify the Company immediately. The Customer agrees to pay for any damages or repairs caused by the misuse or negligence of the Customer.
- Delivery and Pickup
The Company will deliver the Equipment to the Customer at the specified location and time, and will pick up the Equipment at the end of the Rental Period. The Customer is responsible for ensuring that the delivery and pickup location is accessible and safe for the Company’s personnel and equipment.
- Termination
The Company may terminate this Agreement at any time if the Customer breaches any of the terms and conditions outlined in this Agreement. The Customer may terminate this Agreement by providing written notice to the Company.
- Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Equipment is rented or leased.
- Entire Agreement
This Agreement constitutes the entire agreement between the Customer and the Company, and supersedes all prior agreements, understandings, and negotiations, whether written or oral. No amendment or modification to this Agreement shall be valid unless in writing and signed by both parties.
- Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
